THREE-YEAR LIMITED CONNECTED EQUIPMENT WARRANTY

Navajo Manufacturing Company Inc. (“Navajo”) warrants to the original purchaser of this product (the “Product”) that the Product shall be free from defects in material, assembly or workmanship, under normal use and will repair or replace, at its option, any defective product, upon return as described below, free of charge for a period of three years from the date of the purchase. This Limited Warranty extends only to the product part numbers identified at https://hottipsusa.com/pages/warranty. This Limited Warranty does not extend to damage or failure which results from normal wear and tear, misuse, neglect, accident, alteration, abuse, improper installation or maintenance.

This warranty covers equipment or devices (“Connected Equipment”) that are damaged by transient voltage while properly connected to a Product that is properly connected to a properly-wired AC power line or a standard 12v DC power source such as the cigarette lighter of a passenger vehicle (an “Occurrence”). This is a Limited Warranty and is subject to all limitations and exclusions set forth below. All claims related to the Product or Connected Equipment must be made within 15 days from the date of the Occurrence or the warranty is void. Warranty is valid in, and covers only Occurrences that take place in, the USA, Canada, and Puerto Rico. Navajo will repair or replace the damaged Connected Equipment, at Navajo’s option, in a dollar amount up to or equal to the fair market value of the Connected Equipment at the time of the claim or the original purchase price of the Connected Equipment, whichever is less. Navajo reserves the right to fully inspect the damaged Connected Equipment and the site where the damage occurred. All costs of shipping the Product and the damaged Connected Equipment to Navajo for inspection shall be borne solely by the purchaser. Navajo reserves the right to negotiate the cost of repairs, as applicable. If Navajo determines, at its sole discretion, that it is impractical to ship the damaged Connected Equipment, it may designate an equipment repair facility of its choosing to inspect and estimate the cost to repair such Connected Equipment. Any cost of shipping the equipment to and from such repair facility shall be borne solely by the purchaser. Damaged Connected Equipment must remain available for inspection until the claim is finalized. Whenever claims are settled, Navajo reserves the right to be subrogated under any existing insurance policies the purchaser may have or that may be applicable to the Connected Equipment. Purchaser expressly acknowledges and grants Navajo such subrogation rights by accepting any payments made by Navajo for their claim related to an Occurrence.

All warranties contained herein are null and void if: The Product involved in the Occurrence is not provided to Navajo for inspection; Navajo determines that the Product has been opened, tampered with, improperly installed, or altered in any way; Navajo determines that the damage did not result from the Occurrence or that an Occurrence did not occur; the cost of repair or replacement of the damaged Connected Equipment is covered under another warranty of any kind; or Navajo determines that the Product or Connected Equipment was not used under normal operating conditions, or in accordance with the warranty or applicable manufacturers’ instructions. All Products must be plugged directly into a properly-wired AC power line or standard 12V DC power source and may not be “daisy-chained” together in serial fashion with other power strips, UPSes, surge protectors, other charging products, three-to-two-prong adapters, or extension cords. Any such installation voids the warranty. This Connected Equipment Warranty only protects against damage to properly-connected and operated Connected Equipment where Navajo has determined, in its sole discretion, that the damage resulted from an Occurrence, and does not protect against intervening causes (other than lightning) such as flood, earthquake, war, vandalism, theft, normal-use wear and tear, erosion, depletion, obsolescence, abuse, damage due to low-voltage disturbances (e.g. brownouts or sags), non-authorized program, or system equipment modification or alteration. Do not use the Product with any electrical source besides a properly-wired AC power line or standard 12v DC power source, including a generator, motorcycle, marine vessel, commercial truck, aviation aircraft, or golf-cart battery charger. Do not use the Product to power any critical equipment, including, but not limited to any heater, sump pump, water-related device, life support device or medical device. Navajo Wall Charger Products must be used indoors only. All Products must be used in dry areas only. All warranties contained herein are null and void if the Product is used contrary to any of these instructions.

This is Navajo’s sole warranty related to Connected Equipment. This warranty is nontransferable.

REPAIR OR REPLACEMENT AS PROVIDED UNDER THIS WARRANTY IS THE EXCLUSIVE REMEDY OF THE CONSUMER. EXCEPT FOR THE WARRANTIES CONTAINED IN THIS LIMITED WARRANTY, NAVAJO MAKES NO OTHER WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, IN FACT OR BY LAW, WHETHER OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE OR OTHERWISE. YOUR SOLE AND EXCLUSIVE REMEDY UNDER THIS LIMITED WARRANTY SHALL BE PRODUCT REPAIR OR REPLACEMENT AS PROVIDED HEREIN.

In no event shall Navajo be liable for lost data or incidental, special, direct, indirect, and consequential or multiple damages such as, but not limited to, lost business or profits arising out of the sale or use of any Navajo Product, even if advised of the possibility of such damages.

If Navajo determines that the problem with the Product is not covered under this Limited Warranty, we will notify you and inform you of service or replacement alternatives that are available to you on a fee basis.

Some states and countries do not allow limitation on consequential damages or how long an implied warranty lasts, or exclusion of all or certain types of damages, so the above limitations may not apply to you. This Limited Warranty gives you specific legal rights, and you may also have additional rights, which vary from state or country. The foregoing is without prejudice to other legal rights that may arise under applicable legislation. In the event of any dispute regarding the Product, the Purchaser and Navajo agree to resolve any Claims only by BINDING ARBITRATION that must be brought in Denver, Colorado. Such arbitration will be conducted under the Streamlined Arbitration Rules of JAMS. For the purposes of this section, references to “Purchaser” include the original purchaser, their family members, beneficiaries, and assigns, and references to “Claim” shall include any dispute, claim or controversy arising from or relating to: (1) the Product or Connected Equipment, whether based in contract; tort; fraud; misrepresentation; state or federal statue, regulation, ordinance; or any other legal or equitable theory, and (2) this Limited Warranty. There shall be no right or authority for any Claims to be arbitrated on a class action basis. This Dispute Resolution Agreement is part of a transaction involving interstate commerce and is governed by the Federal Arbitration Act, which governs its enforcement and interpretation. To file a claim under this Limited Connected Equipment Warranty, you must take the following steps:

Be prepared to provide the following information:

  2. Full description of the Connected Equipment:
  3. The date of the Occurrence:
  4. Date and location that you purchased the Product and
  5. A copy of the original purchase receipt or other proof of purchase.

Your Navajo Customer Support Representative will then instruct you on how to forward your Product, receipt, and Connected Equipment, if applicable, and how to proceed with your claim. All claims must be filed, within 15 days of the Occurrence or the warranty is null and void, and all Products must be returned to the address below with a fee to cover shipping and handling of the replacement Product. Any replacement under this warranty will only be made with the same or similar Product of the same or similar value and will not include cash, credits, or other types of Products.

Navajo strives to provide a timely warranty process and will work to perform its obligations under this warranty within 30 days, under normal conditions, after the warranted product is returned as set forth above. This period may be extended if replacement products are out of stock or other unusual circumstances require longer. All repaired or replacement product will be covered for one year from the date of the original Product purchase.
